What hapeens when a payday advance loan goes unpaid ?
My sister-in-law has about 4 payday advance loans that she's not paying. I've told her that she could go to jail for this. SHe says no she cant because its a loan,not a bad check. Does anyone know?

    Normally when taking out a payday loan you have to write post-dated checks which they then will cash once the agreed upon day arrives. If there isn't money to cover the checks when they attempt to cash them, then they will file hot check charges against her and she can go to jail especially if she knew the money wasn't going to be available since that's theft by deception.

    Payday loans benefit people who get paid monthly. You have to wean yourself off them and that is what I am doing. I believe that the government should regulate the interest of payday loaners. People will call that socialism, but it is better to do that then to take advantage of low income middle class people. School systems, parents, communities, and our federal government need to take a class in economic and financial literacy.

    I would never make a deal with the payday devil again. Credit Unions (especially State) offer a much better salary loan advance if your in need of money…for me it works so much better and intrest is much lower and the best part is the intrest taken goes into a separate savings account.

    No Payday Loan companies will loan you money without a bank account. You can get a bank account for people with bad credit, possibally at US Bank or Bank of America.

    The only other option is a pawn shop. They will take an item worth let's say $1,000 and give you a loan of say $250. If you payback in 30 days then you get your item back, if not, then they sell it. Things like Rings, TVs, Computers, etc. Call them and ask them what they want. Look it up online or in your local phone book.

    You will need an ID and you will need to fill out paperwork incase it is found that your colateral is stolen, they can then turn you into the police. With Mr Money USA and other pawn shops you don't need a checking account, just and ID and a piece of mail and an item of value as far as I know.

    I hope you are not on his checking account first of all. No offense, but you don't want to be in the hole with him. He needs to seek outside help. Go to the bank (if he has a good relationship with them) and see if they can help him. If not, he needs to find a friend or family member that could/would loan him the money all at one time so that he could pay them off. It is a vicious cycle!!

  9. While it may seem simplistic, this is the correct financial advice: When you find yourself in a hole, the first order of business is to STOP DIGGING!

    The only way out is to strictly budget your money until you have expenditures to the bare minimum. (that includes expensive coffees or eating out). If you have to eat baloney sandwiches for dinner for a while then that is what you do.

    Check your states rules on payday loans some have outlawed them and the borrower does NOT have to pay them back.

    However, lets assume it is legit in your state they can take you to court and WILL and get a judgment. Then they can ganish your wages or empty your bank account.

    oh dear. u just had to get yourself into this trouble. if cc are snakes that will bite if you play with them then this is the biggest snake that will swallow you whole and alive. stay away from payday lenders. the interest rate is killer and you don't have to go to them for money. why don't you save your check and do whatever it is that you need to do cash paid? just wait save enough $$ and go pay for it.

    get the book Total money make over by dave ramsey. it will teach you alot about personal financing and what i am telling you.

    Its worse than "not a good idea". It could ruin your finances for a very long time. Please do not take out a payday advance. I have not heard of anyone who ever took out a payday advance saying that they were happy with their decision. There are always more options. Have you tried talking to your creditors? A payday advance should be the last alternative, and should be used to make sure you don't go to jail. Otherwise, it is a bad decision.

    If you have taken out a payday advance then more then likely your credit is already disturbed. You should of just went to a bank and have taken out a loan. You do however have the option of negotiating with the payday advance meaning that you would tell them how much you can afford to pay at this present time and say "if cannot except this than I will not pay for this balance for it will already hurt my credit". More then likely they will go with your payment amount as long as its an understandable amount. You have 30 days to pay off a balance before they can initially send it through to the credit report. Whether you pay this balance completely off or not check your credit report 6 months after this situation for the credit report bureau that is closest to your region. If you do pay this balance back in full make SURE YOU SAVE THE RECEIPT and stick it in a safe place. You will need this information to fax to the credit bureau if they do still send your unpaid balance to the credit report bureau. The receipt can be faxed to each agency and be used to change the status of your report to paid instead of having what's called a charge off on your credit. Good luck

    That sucks. They are taking advantage of people who they know will not have the money to fight them in court. Report to Better Business Bureau and to FCC as fraud. They both have consumer complaint forms and numbers on their website. They may waive the charge to get the feds off their back. It sounds like you may have been taken by a scam. Definitely dispute the charge with your credit card company. And next time, read the fine print.

    i work at a similar place and basically if you want to get rid of that debt next time you go in pay it back and reloan it but do it for $25/$50 less and keep decreasing the amount until its not overwelming
